ABSTRACT:
If courts were not obliged to give judgments, they would not be useful institutions, and they would have been redundant by now. People take their disputes to the courts because they want the courts to make a decision to resolve them. There will be no motivation for people to take their disputes to the courts if the courts were not obliged to give judgments. Judgments then, are the conduits to justice. The only way courts can serve justice is through their judgments, and so Neuberger1 (2012), was right to observe that, without judgments there would be no justice. Quality judgments are therefore sine quibus non of democratic states.
